Answer» As per Indian Constitution India is union of states. Our Constitution makers avoided the word feredaration. Our Constitution can be said federal with unitary bias.As features that make our Constitution federal are:-states are given due representation in both houses of parliament.- subjects of local importance are listed in list 2 of schedule 7 on which state government makes law.-state legislatures are given due representation in election of president. But certainly indian Constitution can be said of unitary in spirit as:- India has single citizenship, single flag, single Constitution, integrated judiciary.-States can't separate from India. India is said to indestructible union of destructible states. Name, area, boundary of states can be changed by parliament.- emergency powers lie with central govt. In case of emergency central govt can control legislative and executive powers of states.- All India Service's officers are appointment by central govt. Centre can influence state govt's policy through these officers.-According to article 312, If rajya sabha feels any issue of national importance, they can pass a resolution so that central govt will make law on this subject.-power to make laws on residuary list lie with central govt. The Indian Constitution has got features of federal polity as well but the balance of power lies towards central govt. Thus we can say India has federal Constitution with unitary spirit. |
