Merits and demerits of Indian judicial system

Answer»

Hope !!! It will help You .

Merits

1.     Judges are competent to make judicial review by virtue of their knowledge and experience.

2.     It enables the federal JUDICIARY to act as the guardian of the constitution.

3.     The courts are independent and less biased than legislatures.

4.     It protects the fundamental rights of the people in PARTICULAR the rights of the minorities.

5.     It is necessary to PRESERVE a free and limited government.

6.     It enables the judiciary to guard against legislative haste and rashness.

De-merits

1.     It may violate the spirit of separation of powers.

By giving the power of judicial review to the courts the smooth functioning of the representative system of government is affected as the courts infringe upon the legislative and executive functions.

3.     Judicial review delays the operation and implementation of important and pressing social policies so necessary for the needs of a dynamic society.

4.     Almost all problems coming before the judges involves issues of political, economic and social importance and legislation on them. Thus it makes the judiciary a super legislature.

5.     Issues brought before the courts are decided by a MAJORITY of single judge (in the U.S.A. five to four majority). It shows how the judges are sharply divided amongst themselves and their judgement vitally affects the nation as a whole.

6.     Judges may over look the challenges of the changing times and may refuse to move forward. They may become conservative.

Advantages and disadvantage of indian democratic government

Answer»
\huge \textbf{hello}

\textbf{here \: is \: your \: answer}

\underline \textbf{advantage \: of \: democracy \: are}
1.The Indian government gives many chances to CHANGE our government as it holds election at each 5 years.

2.In Indian democracy there are many options to select our leader as if we compare the Indian government to the Government of USA then in America there are only two parties while in India there are many parties in this way we can select our bestest leader.

3. The Indian government gives chance to criticise the government.

4.Right to media. As in India the media can oppose questions to the present government as well as the back government can take the details of the POLICIES of the government.

\underline \textbf{disadvantages \: of \: indian \: government \: }

1.In Indian democracy the leader try to collect money that is called corruption.

2.In democracy there is value of leaders more then the EDUCATIONAL PEOPLE like district magistrates and many other.

3.It takes lot of time because elections are held and too much money is lost.

In this way we can say that the democracy is better than the other forms of the government but we cannot say that democracy is it best government because still having a good constitution there is corruption this is a reason that's why in India the government is not repeated after once.

Describe the challenge to free and fair election in india

Answer»

Candidates and PARTIES with a lot of money may not be sure of their victory but they do enjoy a big and unfair advantage over smaller parties and independents.In some parts of the country, candidates with criminal connection have been able to secure a ‘ticket’ from major parties.Some families tend to DOMINATE the political parties; tickets are distributed to relatives from these families.Very often, elections offer little choice to ordinary citizens as both the major parties are SIMILAR to each other in their policies and practices.Smaller parties and independent candidates SUFFER a huge disadvantage as compared to the BIGGER parties.

Do you think educational qualification should be necessary for the candidates aspiring to fight election ? As per your view what should be an education qualification required for candidates

Answer»

Yes educational qualifications are really important for a candidate to get elected
without education, they are behind and we are also LAGGING behind because of them
education HELPS to increase the the thinking capability, it makes us differientiat between right and wrong and especially candidates. thought it's necessary for them to act smartly and logically for our welfare if they are not educated then they will definitely do some nonsense in constitution and do stupid things
educated people have resoning mind that help us to grow, it is really necessary for us to choose wisely , whom to choose and why to chose our decision is in our hand so make the right choice. although I believe that a LEADER should be elected by his good behavior and COMMUNICATION skills not by degrees but it's important and mandatory too

the educational qualifications should be :

. history
. international relations
. should be a citizen of INDIA
. should be above 25 yrs old
. should not hold any office of profit
