পারিবারিক সম্মান ও পারিবারিক সম্পত্তির কথা বিবেচনা করে, উচ্চ-বর্ণবাদী হিন্দু সমাজ দীর্ঘদিন ধরে বিধবা, এমনকি শিশু ও কিশোর-কিশোরদের পুনর্বাসনের বা বিয়ের অনুমতি দেয়নি, যার ফলে তাদের অনেক নিষ্ঠুর ও বঞ্চনায় জীবনযাপন করতে হত। বিধবারা এমনকি যারা শৈশবে বা কৈশোরে বিধবা হয়েছিলেন তারাও বৈরাগ্য ও কঠোর ত্যাগস্বীকার করে জীবনযাপন করতে বাধ্য হতেন। তথাকথিত পরিবারের সম্মান ও পারিবারিক সম্পত্তি রক্ষা করার জন্য এরকম নিয়ম করা হয়েছিল।

পণ্ডিত ঈশ্বর চন্দ্র বিদ্যাসাগরের অক্লান্ত প্রচেষ্টায় ব্রিটিশ সরকার ভারতে হিন্দু বিধবা পুনর্বিবাহ আইন-১৮৫৬ প্রণয়ন করেন। যার মাধ্যমে বিধবাদের উত্তরাধিকারসূত্রে প্রাপ্য সম্পত্তির অধিকার ইত্যাদি সামাজিক রক্ষাকবচ প্রদান করা হয়। এই আইন করার লক্ষ্য ছিল কিছু হিন্দু বিধবা শিশু, যারা স্বামীর বাড়িতে যাবার আগেই বিধবা হয়ে যেতো তাদের রক্ষা করা।

দ্য হিন্দু উইডো’স রিম্যারেজ অ্যাক্ট, আইনটি ১৮৫৬ সালের ২৬ জুলাই প্রণয়ন করা হয়। ইস্ট ইন্ডিয়া কোম্পানির শাসনাধীনে ভারতবর্ষের সকল বিচারব্যবস্থায় হিন্দু বিধবাদের পুনর্বিবাহ বৈধ করেছিল। বিদ্যাসাগরের প্রচেষ্টায় তৎকালীন বড়লাট লর্ড ডালহৌসি আইন প্রণয়ন করে বিধবা বিবাহকে আইনী স্বীকৃতি দেন। লর্ড উইলিয়ম বেন্টিনয়ের দ্বারা সতীদাহ বিলুপ্ত করার পর এটিই প্রথম বড় সমাজ সংস্কার আইন।

ইতিহাস থেকে জানা যায়, সংস্কৃত কলেজের অধ্যাপক শম্ভুচন্দ্র বাচস্পতির বালিকাবধূর অকালবৈধব্য বিদ্যাসাগরকে এই ‘মহৎ কর্মে ব্রতী’ হওয়ার জন্য প্রাণিত করে। বীরসিংহে বিদ্যাসাগরের এক বাল্যসহচরী ছিল। সে অকালে বিধবা হয়। এক দিন তিনি শুনলেন একাদশী বলে মেয়েটি সারা দিন খায়নি। আর এটি শুনে তিনি কেঁদেই ফেললেন। এ দুটো ঘটনাই তার ছাত্রজীবনে ঘটা।

এছাড়া এক দিন বিদ্যাসাগর বাড়ির চণ্ডীমণ্ডপে বসে বাবার সঙ্গে স্থানীয় বিদ্যালয়গুলোর অবস্থা সম্পর্কে আলোচনা করছিলেন। তখনই তার মা সেখানে এসে একটি বালিকার বৈধব্য-সংঘটনের কথা বলেন।

তিনি বলেন, ‘তুই এত দিন যে শাস্ত্র পড়িলি, তাহাতে বিধবাদের কোনও উপায় আছে কিনা?’

তার বাবাও তখন জানতে চাইলেন, ‘ধর্মশাস্ত্রে বিধবাদের প্রতি শাস্ত্রকারেরা কী কী ব্যবস্থা করেছেন?’

এর পরই নাকি ‘শাস্ত্র-সমুদ্র মন্থন’ করে তিনি লিখলেন, ‘বিধবাবিবাহ প্রচলিত হওয়া উচিত কিনা’ শীর্ষক একটি প্রবন্ধ। যা ১৮৫৪-র ফেব্রুয়ারিতে ‘তত্ত্ববোধিনী পত্রিকা’য় প্রকাশিত হয়। ১৮৫৫’র জানুয়ারিতে প্রকাশিত হয় তার ‘বিধবাবিবাহ প্রচলিত হওয়া উচিত কিনা এতদ্বিষয়ক প্রস্তাব।’ এর পরই শুরু হয় প্রবল আলোড়ন। যার শেষ হয় ১৮৫৬’র ২৬ জুলাই বিধবাবিবাহ আইন অনুমোদিত হলে।
