I believe, in some situations, they will ISSUE a valid product key to you so that you can legally use your edition of Windows. If you don't have the know how to check if everything is legit on a computer from a private seller then don't purchase it. Strictly speaking the seller has no obligation now to provide legitimate software as I'm sure it was purchased 'as is'. He can always argue that is was fine when he sold it.
